Privacy Policy

Kling O1 Pro, Inc. ("Kling O1 Pro," "Kling," "we," "our," or "us") builds tools that let you upload reference assets, orchestrate the Kling O1 Image and Video models, and manage the content you generate. This Privacy Policy describes how we collect, use, and share information when you access any Kling O1 Studio experience, including the image studio, video studio, frames workflow, asset library, or associated APIs and marketing sites.

We believe in transparent data practices, minimal retention, and controls that clearly explain how your prompts, reference uploads, and generated assets are treated. By using the Service you agree to this Privacy Policy. If you do not agree, please discontinue use.

This Privacy Policy is incorporated into our Terms of Service and applies to the personal information we process when you use the Service. If you have a separate written agreement with us (for example, an enterprise agreement), that agreement may include additional privacy terms that apply to your organization.

Definitions

  • "Reference Assets" means images, videos, frames, audio, files, and other materials you upload, import, or otherwise provide to the Service.
  • "Inputs" means your prompts, instructions, parameters, seeds, and other data you submit to generate or edit content (including any Reference Assets you choose to use as inputs).
  • "Generated Content" or "Output" means content produced by the Service in response to your Inputs, including images, videos, and derived assets.

1. Information We Collect

1.1 Account & Billing Information

  • Contact details such as name, username, email address, locale preferences, and authentication credentials.
  • Billing information supplied to our payment processors (e.g., card data, billing address). We never store full card numbers on our servers.

1.2 Reference Assets & Generation Inputs

  • Text prompts, negative prompts, seed values, and control settings.
  • Uploaded reference images, elements, videos, audio, or first/last frame pairs (collectively, "Reference Assets").
  • Generation job metadata such as timestamps, model and feature selection, duration, and credit cost.

1.3 Generated Content (Output)

  • Output you create, along with associated job metadata.
  • Thumbnails, metadata, or low-resolution previews that help power galleries, prevent abuse, or improve the user experience.

1.4 Usage, Device, and Log Data

  • Information about how you use the Service (for example, pages visited, actions taken, and feature usage).
  • Device and connection information (for example, browser type, device identifiers, IP address, and approximate location derived from IP).
  • Log data such as diagnostic information, crash reports, and performance metrics.

1.5 Cookies and Similar Technologies

We (and our service providers) may use cookies, local storage, SDKs, and similar technologies to:

  • Keep you signed in and maintain session state.
  • Remember preferences and settings.
  • Protect against fraud and abuse.
  • Measure and improve performance.

You can control cookies through your browser settings. Disabling cookies may affect certain Service features.

1.6 Communications

  • Messages you send to us (for example, support requests, bug reports, or feedback) and related metadata.
  • If you choose to receive marketing or product updates, your communication preferences and opt-out status.

2. How We Use Information

We use the information we collect to:

  • Provide and operate the Service (including processing Inputs, generating Output, storing assets you choose to store, and delivering downloads and share links).
  • Authenticate and secure accounts, prevent abuse, enforce our policies, and protect the integrity of the Service.
  • Process payments and manage Credits, subscriptions, invoices, taxes, and refunds/credits where applicable.
  • Provide customer support and respond to requests.
  • Improve the Service, including debugging, performance analysis, and product development.
  • Comply with legal obligations and respond to lawful requests.

3. How We Share Information

We may share information in the following circumstances:

3.1 Service Providers and Model Partners

We use vendors and partners to help provide the Service (for example, cloud hosting and storage, content delivery, payment processing, customer support tools, and model inference providers). This may require sharing:

  • Account identifiers and usage data to operate and secure the Service.
  • Inputs, Reference Assets, and Output with model partners and infrastructure providers as needed to generate Output and deliver the Service.

These providers are authorized to process information only as necessary to provide services to us and are required to protect it.

3.2 Payment Processing

Payments are handled by third-party processors (e.g., Stripe/Creeem). We receive limited payment-related information (for example, the last four digits of a card, card brand, billing status, and transaction identifiers) and do not store full payment card numbers on our servers.

3.3 Your Sharing Choices

If you choose to share Output (for example, via a share link, export, or publish feature), the recipients you choose may be able to view or copy that content. Please share carefully.

We may disclose information if we believe in good faith that doing so is necessary to:

  • Comply with law, legal process, or government requests.
  • Protect the rights, property, or safety of our users, the public, or Kling.
  • Investigate and enforce our Terms, prevent fraud, or address security issues.

3.5 Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction, subject to standard confidentiality protections.

4. Data Retention

We retain personal information for as long as reasonably necessary to provide the Service and for legitimate business purposes, such as:

  • Maintaining your account and providing access to stored assets while your account is active.
  • Keeping records required for billing, tax, accounting, or legal compliance.
  • Enforcing our Terms and protecting the Service from fraud or abuse.

If you close your account, we may delete or anonymize your stored Reference Assets and Output after a reasonable period, subject to legal obligations, dispute resolution needs, safety requirements, and backup/archival practices. You are responsible for keeping your own backups of any Output or Reference Assets you wish to retain.

5. Security

We implement administrative, technical, and physical safeguards designed to protect personal information. However, no system is perfectly secure, and we cannot guarantee absolute security.

6. International Transfers

We may process and store information in the United States and other countries where we or our service providers operate. These locations may have data protection laws that differ from the laws of your jurisdiction.

7. Your Choices and Rights

Depending on where you live, you may have certain rights regarding your personal information, such as:

  • Accessing, correcting, or deleting your personal information.
  • Requesting a copy (portability) of certain information.
  • Objecting to or restricting certain processing.
  • Withdrawing consent where processing is based on consent.

You can opt out of marketing emails by using the unsubscribe link in those emails or by contacting us.

8. Children’s Privacy

The Service is not directed to children. Do not use the Service if you are under 13 (or under the minimum age required in your jurisdiction). If you believe a child has provided personal information to us, contact us and we will take appropriate steps.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. The "Effective Date" above indicates when this Privacy Policy was last updated.
